The voluntary pledge from six AI heavyweights could harden into law, meaning whoever ends up defined as an 'independent evaluator' will hold real regulatory power over frontier models.
The most consequential word in the White House Accord on Super Intelligence may also be its least defined: independent.
At a signing this week, the leaders of Google, OpenAI, Anthropic, Meta, xAI and Nvidia committed to a four-tier oversight structure for frontier models. The stack runs from internal controls at the base, to an in-house team charged with verifying them, to an external auditor or evaluator positioned as independent, and finally to an independent committee at board level. Of the four tiers, outside assessment carries the most weight — and it is exactly there that the accord goes quiet on who qualifies.
None of this is binding yet. The accord itself contemplates that its terms could eventually be written into law.
That trajectory is what converts a drafting gap into a structural one. Voluntary pledges leave room for interpretation; statutes do not. If the external-audit tier is ever codified without a settled definition of who counts as independent, the term will arrive in regulation pre-shaped by the companies it is meant to check. The six signatories are, in effect, positioned to influence what independence means before any regulator defines it for them.
The ambiguity has a practical edge, too. Three of the four tiers sit inside the companies' own walls, where existing governance norms already apply. The external tier is the only one that presupposes an outside party — which makes it the only one that cannot function until someone answers the doorkeeping question of what makes an evaluator genuinely independent. The accord's four-layer architecture is only as strong as its least specified component, and that component is the one doing the heaviest lifting.
Until that definition arrives, the accord's load-bearing commitment rests on a word its signatories — and any future legislature — remain free to define as they see fit.
