At the center of the dispute is a question the American legal system has not settled: do state gambling laws reach prediction markets, or does federal oversight displace them? Kalshi's national operation is built on the federal reading. The states pressing against the company invoke the other. Because the appeals courts have now ruled in conflicting directions, neither camp can claim the law is settled in its favor everywhere — and every operator in the sector inherits the ambiguity.

For a platform selling one product nationwide, a judicial split is in some ways worse than a clean adverse ruling. A single loss presents a defined question for further review. Whether a prediction market position is a federally overseen financial product or an unlawful wager now depends on where the question is asked, and by whom.
